Terms of Service for Paradox

1. Acceptance of Terms

By accessing or using Paradox ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you may not use the Service.

2. About Paradox

Paradox is an AI-augmented writing and creative environment operated by Anomaly LLC-FZ, a limited liability company incorporated in Dubai, United Arab Emirates.

The Service enables users to create, refine, and manage written content using locally and cloud-based tools, including AI models, versioning, and export utilities.

3. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By creating an account, you confirm that you meet this requirement and that you have the legal capacity to enter into this Agreement.

4. Accounts and Authentication

• You may register for Paradox with an email and password, or via third-party authentication (e.g., Google).
• You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
• You agree to notify us immediately of any unauthorized use or suspected breach.
• In the future, Paradox may allow anonymous or pseudonymous logins via Bionic ID, giving you additional privacy options.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in misuse.

5. Use of the Service

You may use Paradox solely for lawful personal or business purposes in accordance with these Terms. You agree not to:

• Use the Service for unlawful, deceptive, or harmful purposes.
• Upload or transmit malicious code or automated scripts that degrade system performance.
• Interfere with the Service's integrity, servers, or networks.
• Reverse engineer, decompile, or attempt to extract source code.
• Use the Service to generate or disseminate false, abusive, or infringing material.

We reserve the right to restrict or terminate your access if your use violates these principles or applicable law.

6. User Content and Ownership

• You retain full ownership of the text, documents, images, and other materials you create or upload ("Content").
• By using Paradox, you grant Anomaly a limited, revocable, non-exclusive license to store, process, and display your Content solely to provide the Service.
• We do not claim ownership of your intellectual property and do not train AI models using your Content.

You are responsible for ensuring that your Content complies with applicable laws and does not infringe on third-party rights.

7. AI Services and Model Providers

When you request AI-based assistance (such as refinement, completion, or translation), your data may be processed by one or more third-party model providers:

All transmissions are encrypted (TLS 1.2+) and transient — data is not stored for training. We select and rotate providers based on compliance, performance, and data residency guarantees. We reserve the right to add, change, or drop providers at any time.

Bring Your Own Key (BYOK): If you choose to use BYOK, you are responsible for providing, maintaining, and paying for your own API keys. Your use of provider services is subject to the provider’s terms. We do not guarantee availability of any specific provider, and we may disable or restrict BYOK access for security, compliance, or misuse.

8. Subscriptions, Billing, and Payment

Paradox offers both free and paid tiers.

• Payment processing is handled by Stripe and the Apple App Store (for macOS/iOS).
• Pricing, limits, and usage entitlements are displayed at purchase.
• Fees are non-refundable except where required by law.
• We may suspend or downgrade service if payment fails or misuse is detected.

Trial and Promotional Offers:
Trial access is time-limited and may convert to a paid plan unless canceled before expiration.

Lifetime Plans: “Lifetime” means access for the lifetime of the Service. We do not guarantee perpetual availability, and the Service may be modified or discontinued. We intend to provide at least 12 months of access from the date of purchase, unless access is terminated for cause.

9. Data Residency and Hosting

All user data is stored with DigitalOcean in the Singapore (SGP) region. Email delivery is handled by AWS SES, and notifications are powered by Upstash. Payments are processed globally by Stripe and Apple App Store.

We choose partners who comply with recognized international privacy and security standards (GDPR, ISO 27001, PCI-DSS).

10. Service Availability and Modifications

We aim for continuous availability but cannot guarantee that the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the Service at any time — for maintenance, security, or legal reasons — with or without prior notice. We are not liable for any loss resulting from such interruptions or modifications.

11. Intellectual Property

All intellectual property related to Paradox (software, design, logo, branding, documentation) is owned or licensed by Anomaly LLC-FZ. You may not copy, distribute, modify, or use these materials beyond what is permitted by this Agreement.

12. Privacy and Data Handling

Your use of the Service is governed by our Privacy Policy, which forms an integral part of these Terms. By using Paradox, you consent to our data practices as described therein.

We do not monetize or sell personal data. All processing aligns with principles of data minimization and user autonomy.

13. Third-Party Services

Paradox may integrate or interoperate with third-party APIs or platforms (e.g., Google Drive, Ghost, WordPress). Third-party analytics may be introduced over time, and we will try to integrate privacy-friendly options to the extent they are available and feasible. Use of those services is subject to their respective terms and privacy policies. We are not responsible for third-party content or data handling practices.

14. Termination

You may terminate your account at any time by deleting it within the app or contacting [email protected]. We may suspend or terminate access if:

• You breach these Terms.
• Required by law or regulation.
• Payment obligations remain unpaid.
• Activity is deemed abusive or harmful.

Upon termination, your account and Content will be deleted in accordance with our Privacy Policy.

15. Disclaimers

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding availability, accuracy, or reliability. Your use of AI outputs is at your discretion — you are responsible for reviewing and verifying generated content.

We do not guarantee that AI-generated material will be accurate, lawful, or fit for any purpose.

16. Limitation of Liability

To the fullest extent permitted by law:

• Anomaly LLC-FZ and its affiliates will not be liable for indirect, incidental, or consequential damages.
• Total liability for any claim shall not exceed the amount paid by you for the Service in the 12 months preceding the incident.

Some jurisdictions do not allow certain limitations, so these may not apply in full.

17. Indemnification

You agree to indemnify and hold harmless Anomaly LLC-FZ, its officers, and employees from any claims, damages, or expenses arising from:

• Your use of the Service;
• Violation of these Terms; or
• Infringement of third-party rights through your Content.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising from or relating to these Terms shall be resolved by arbitration or competent courts in Dubai, unless otherwise required by local law.

19. Changes to the Terms

We may revise these Terms as the Service evolves. Updated Terms will be posted with a new "Effective Date." Continued use after changes constitutes acceptance. If a change materially affects your rights, we will notify you within the app or via email.
